These Terms and Conditions ("Terms") govern your access to and use of TCG Report App ("App", "Service", "we", "us", or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction, to use the App.

If you are under the age of majority in your jurisdiction, you may only use the App with the permission and supervision of a parent or legal guardian.

3. Description of the Service

TCG Report App provides tools and features related to trading card game reporting, data management, analysis, organization, and related functionality.

Features may change from time to time, and certain features may be added, modified, restricted, or removed without prior notice.

4. Beta Software Notice

Some or all portions of the App may be provided in beta, preview, early-access, or testing form.

Beta features may contain bugs, errors, inaccuracies, interruptions, or other issues not present in final releases.

You acknowledge that beta software is provided for evaluation and testing purposes and may not perform as expected.

5. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for personal or internal business purposes.

No ownership rights are transferred to you.

6. Intellectual Property Rights

The App, including its software, design, text, graphics, logos, documentation, source code, functionality, and other content, is owned by or licensed to us and is protected by applicable intellectual property laws.

All rights not expressly granted in these Terms are reserved.

7. Restrictions on Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App except where permitted by law.
  • Modify, adapt, or create derivative works of the App.
  • Use the App for unlawful purposes.
  • Attempt to interfere with or disrupt the App.
  • Introduce malware, viruses, or harmful code.
  • Attempt unauthorized access to systems or data.
  • Use automated tools to abuse, overload, or exploit the App.
  • Infringe any intellectual property rights.

8. User Content and Data

Users retain ownership of the information, content, and data they provide to TCG Report App and of the TCG Reports generated from that information.

However, TCG Report App retains all right, title, and interest in and to its software, source code, trademarks, logos, trade names, branding elements, user interface designs, and other proprietary materials.

Generated TCG Reports may include TCG Report App branding elements, including but not limited to the "Powered by TCG Report App" attribution and the TCG Report App logo. Such branding elements remain the exclusive property of Germán Coines Laguna and are protected by applicable intellectual property laws.

Users may not remove, alter, obscure, misrepresent, or claim ownership of TCG Report App trademarks, logos, copyright notices, attributions, or other proprietary notices included in generated reports.

Except for these branding elements and other proprietary materials owned by TCG Report App, users retain ownership of the report content generated from their submitted information and are solely responsible for ensuring that any content they use within the App complies with applicable laws and third-party rights.

Users may distribute, share, publish, print, or otherwise use TCG Reports generated through the App for personal, professional, educational, or lawful business purposes, provided that any TCG Report App branding, attribution, copyright notices, trademarks, logos, or other proprietary notices included in the generated reports remain intact.

9. Trading Card Information Disclaimer

The App may process, display, organize, or report information relating to trading card games, products, collections, prices, market information, or related data.

Any such information is provided for informational purposes only.

We do not guarantee:

  • Accuracy
  • Completeness
  • Availability
  • Timeliness
  • Suitability for a particular purpose

You are responsible for independently verifying information before making business, collection, purchasing, selling, investment, or trading decisions.

10. Third-Party Services

The App may interact with, integrate with, or depend upon third-party services, platforms, operating systems, marketplaces, APIs, or providers.

We do not control and are not responsible for third-party services or their content.

Your use of third-party services may be governed by separate terms and privacy policies.

11. Updates

We may release updates, bug fixes, patches, security improvements, or new versions of the App.

Some functionality may require installation of such updates to continue operating correctly.

12. Availability

We make reasonable efforts to maintain availability of the App but do not guarantee uninterrupted access.

Access may be suspended, limited, interrupted, or discontinued at any time.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis.

We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

Nothing in these Terms excludes warranties or legal rights that cannot be excluded under applicable consumer protection laws.

14. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Incidental damages
  • Special damages
  • Loss of profits
  • Loss of revenue
  • Loss of business opportunities
  • Loss of data

Our total liability arising from or relating to the App shall not exceed the greater of:

  • Any amount paid by you for use of the App during the previous 12 months; or
  • EUR 100.

The foregoing limitations apply only to the extent permitted by law.

15. Consumer Rights

Nothing in these Terms limits, excludes, or affects any mandatory consumer rights granted under the laws of your country of residence.

If you are a consumer located in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections, those protections remain fully applicable.

16. Indemnification

You agree to indemnify and hold harmless the App operator from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your misuse of the App;
  • Your violation of these Terms;
  • Your violation of applicable laws;
  • Your infringement of third-party rights.

17. Termination

We may suspend or terminate access to the App if:

  • You violate these Terms;
  • Required by law;
  • Necessary to protect the App, users, or third parties.

You may stop using the App at any time.

18. Export Compliance

You agree to comply with applicable export control and sanctions laws when using the App.

19. App Store Terms

If you downloaded the App through Apple App Store, Google Play Store, or another marketplace, you acknowledge that:

  • The marketplace provider is not responsible for the App.
  • The marketplace provider is not responsible for support or maintenance.
  • Your use of the App must comply with applicable marketplace rules.

20. Changes to These Terms

We may update these Terms from time to time.

When material changes occur, we may provide notice through the App, website, store listing, or other appropriate means.

The revised version becomes effective on the date shown above.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, excluding conflict-of-law rules.

If you are a consumer located in the European Union, United Kingdom, or another jurisdiction providing mandatory consumer protections, you continue to benefit from protections granted by the laws of your country of residence.

22. Dispute Resolution

Before initiating formal legal proceedings, the parties agree to make a good-faith effort to resolve disputes by contacting each other directly.

Where required by applicable law, consumers retain the right to pursue claims before competent courts and regulatory authorities.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede any previous agreements relating to its subject matter.
